Terms and Conditions:
PROCEDURE: The farm will be offered in 2 separate tracts. Tract 1: 157.10 +/- acres in the Sw/4 of Section 8-25-12, and Tract 2: 157.27+/- acres in the Se/4 of 7-25-12. 314.37+/- ac Total. This is a Sellers Choice Auction.
DOWN PAYMENT: 10% down payment on the day of the auction. If the buyer defaults on the purchase, the down payment will not be refunded. THIS AUCTION IS NOT CONTINGENT UPON FINANCING.
CLOSING: Closing will be in 30 days or less from the date of the auction. Time is of the essence.
POSSESSION: Possession of the property is contingent upon who the winning bidder is.
The current tenant farmers are on a 1/3rd 2/3rds share crop with the Sellers. Wheat averaged 37 bushels per ac on each parcel. Farmers have agreed to vacate the tillable acres on all tracts. All prepping for the farm land to be planted will be paid by the sellers. (See tract 1 and 2 aerial pages for more info).
Tracts 1 and 2 the sellers have paid for all costs to prep the land for the 2016-2017 winter wheat to be drilled. There are no costs up front for the Buyer to pay for previous prepping of the land. Earlier possession of the property will have to be agreed upon by the Sellers and Buyers day of the auction.
REAL ESTATE TAXES: Real estate taxes for 2015, payable in 2016, shall be seller?s expense. All subsequent real estate taxes will be prorated to the closing date. Last years taxes for Tract 1 =$547.32 Tract 2 = $922.24
ACCEPTANCE OF BID PRICE: Successful bidders will sign a Real Estate Purchase Agreement immediately following the auction. The sellers reserve the right to accept or reject any and all bids.
TITLE: Seller will furnish the successful bidder an Owner?s Policy of Title Insurance in the amount of the purchase price and will provide a deed, subject to standard exceptions, conveying the real estate to the Buyers.
MINERAL RIGHTS: Tract 1 oil production: 614 barrels sold in last two years. Tract 2 oil data: As of August 8th 195 total barrels for the 2016 year. Last two years 1,400 barrels sold. DATA ON OIL ? Averages 2.5-3 tanks per year or roughly 1.5 barrels per day. Approx. sellers share per well = $2,942.75 at 43$ per barrel oil prices. The Sellers have the right to negotiate the sale with or without mineral rights depending on the highest bid. Sale of property shall include any mineral rights owned by the Trust or as Individuals if the highest bid is accepted by the Sellers. The Sellers have conducted a mineral search and do own a full 1/8th on both wells.
Cattle Pasture: Tract 1 the pasture is not leased. Tract 2 the cattle pasture is occupied until Feb 28th, 2017. The pasture income will be prorated to the date of closing.
