N Cornwall official barred from some land votes

LEBANON - Lebanon County Judge John C. Tylwalk ordered North Cornwall Twp. Supervisor Kip Kelly not to vote on matters related to property owned by Springwood Development Partners.
Tylwalk's order on Friday, a response to Springwood's claims that Kelly is biased against the firm, led to a deadlock Monday night on a proposal that would restrict development on agricultural land.
Springwood owns no farmland in the township, but a provision of the ordinance on Monday night's agenda would ban adult-oriented businesses in commercial zones and permit them in manufacturing zones. Springwood has land in both classifications.
Kelly initially seconded Chairman Ralph Heister's motion to adopt the agricultural-land ordinance but withdrew his action after township solicitor James Lillis told him he should not vote. Heister and Supervisor William Gelgot then split on the issue.
The supervisors will meet at 5 p.m. March 19 to consider the ordinance again. The supervisors also authorized Lillis to appeal Tylwalk's injunction to Commonwealth Court.
The agriculture portion of the ordinance discussed Monday would limit the number of homes built on a farm and ban churches, golf courses and schools on agriculture land.
